You do not need to be a member to become either one.

As a tour guide (http://www.disneyonlineworlds.com/index.php/Tour_Guide) you will receive the Tour Guide Hat

However, as a Secret Agent (http://www.disneyonlineworlds.com/index.php/Secret_Agent), you cannot purchase the clothing (not a big deal, only a suit, black sunglasses, bowtie and night vision goggles.) BUT (and this is cool) you can do all the missions! I assume that if you need the night vision goggles for a mission that you will automatically have them in your inventory for that mission only, but I do not know for sure!

nope :) but you do need to be 30 days to be a secret agent and 45 for a tour guide.
